Court sentences Tomlinson in second case
Brad Donald Tomlinson, 69, Morris, was sentenced to 21 months in prison on a count of criminal sexual conduct in the second degree June 18 in Yellow Medicine County District Court.
A jury in Yellow Medicine County had found Tomlison guilty of the charge on April 27. The trial had been moved from Stevens County to Yellow Medicine because of the judge's schedule and publicity following Tomlinson's first criminal sexual conduct trial, Stevens County Attorney Aaron Jordan said in an email.
The 21-month sentence on the second-degree criminal sexual conduct charge is in addtion to 110 months in prison on two counts of first-degree criminal sexual conduct charges involving a seperate victim.
Jordan said in his email that Tomlinson has indicated he intends to appeal the two convictions.
Tomlinson had been charged with five counts of criminal sexual conduct involving four victims in incidents over about 25 years from the 1980s to 2009.
The case involving the oldest alleged sexual abuse was dismissed at an omnibus hearing because it was outside the statute of limitations, Jordan said.
Tomlinson has been in custody since the first sentencing on April 11, Jordan said.
